Planck Health, Inc. (“Planck,” “we,” “our,” or “us”) operates the Planck website, app, dashboards, labs, and related services (the “Platform”). Your use of the Platform — including content, analytics, lab workflows, device integrations, and anything else we provide (the “Services”) — is governed by this Privacy Policy (“Privacy Policy”).
Capitalized words not defined here have the meaning given in our Terms of Service.
This Privacy Policy explains:
- What personal information we collect when you use the Services
- How we use and process that information
- When and why we may share that information
- What rights you have and how to exercise them
By accessing the Services or sending us information by app, web, SMS, chat, or email, you are telling us you’ve read and agree to this Privacy Policy. If you do not agree, do not use the Services.If you’re using the Services on behalf of someone else, you confirm you’re allowed to do that and that they also agree to these terms.
1. Changes to this Privacy Policy and Notices
We can update this Privacy Policy at any time. If we materially change how we handle your data, we’ll either ask you to accept the new version or we’ll notify you through reasonable channels (email, in-app, SMS, or notices inside the Platform). Your continued use of the Services after changes means you accept the updated Privacy Policy.It’s on you to review this Privacy Policy from time to time. We will not retroactively reduce your privacy rights unless we’re legally required to.
2. Information We Collect
The data we collect depends on how you interact with us, what features you use, and what you choose to connect.
(a) Personal Information you give us
Examples include:

Demographics (age, sex, etc.)
Payment / billing info (handled by our payment partners)
Messages you send us (email, SMS, chat)
Connected account info (for example, if you link social, lab portals, or other platforms)
(b) Health / biometric / lab information
With your permission, we may collect what this Privacy Policy calls Healthcare Information, such as: Lab results, bloodwork, imaging, and similar diagnostic dataHistorical conditions, symptoms, medications, or prescriptions relevant to eligibility for certain services. Biometrics and physiological data (like HRV, resting heart rate, sleep staging, recovery, strain, readiness, temperature trends, etc.) from hardware and wearable integrations you choose to connect — including devices like WHOOP and Oura. Prior clinical notes or care history that you share or that an affiliated provider shares with us to deliver services to youWe collect this only if you actively connect it or provide it.
(c) Automatically collected / technical data
When you use the Services we also receive: Device and browser info (IP address, OS, device identifiers), Usage activity (pages viewed, actions taken, session length), Cookie data, analytics events, crash/diagnostic logs, Approximate location (for example city/state/country inferred from IP, or location you tell us)
(d) Inferences
We may generate internal inferences about likely preferences, engagement patterns, or general wellness trends (for example, estimating your general location from IP, or using your historical lab patterns to suggest retesting windows) .We refer to everything above collectively as “Personal Information.” In this Policy, when we specifically mean health-related data, we call it “Healthcare Information.” You can decline to share certain data, use browser/device controls to limit certain collection, or disconnect an integration. If you block necessary data, some features may not work.
3. Company Information
Planck is a technology company, not a medical practice. We may introduce you to independent clinicians, labs, pharmacies, imaging partners, and other licensed professionals (“Affiliated Providers”). Some of those parties are regulated under healthcare privacy law (for example HIPAA in the U.S. or equivalent requirements in other regions), and they have their own Notice of Privacy Practices.When an Affiliated Provider shares Healthcare Information with us so we can support them in delivering services to you (for example: storing records, logistics, messaging, follow-up coordination), we handle that information under the applicable privacy laws and contractual obligations that apply to that provider. We do not use that Healthcare Information for unrelated purposes without proper legal basis or consent.
4. How We Use Personal Information
We use Personal Information (including Healthcare Information, when permitted) to:Provide the Services you requested (dashboards, insights, appointments, follow-up, summaries)
Determine eligibility or availability of certain services in your location (for example, lab draws or prescription workflows may be limited by region or medical rules)
Operate, maintain, and improve the Platform, including building new features and training internal quality systems
Communicate with you about your account, billing, and changes to terms, policies, or product features
Coordinate with Affiliated Providers or partner labs/pharmacies when you ask us to
Comply with legal or regulatory obligations (for example, responding to lawful requests from authorities)
Protect our rights, safety, property, users, or the public
Detect, investigate, and prevent fraud, abuse, or security incidents
Conduct research, testing, analytics, product development, and performance tracking
Send marketing, product updates, promotions, and educational content (you can opt out of marketing any time)
We may de-identify data (remove personal identifiers so it no longer reasonably identifies you) and use or disclose that de-identified data for any business or research purpose allowed by law
5. Cookies, Pixels, and Similar Tech
We (and our analytics/measurement partners) use cookies, local storage, mobile advertising IDs, web beacons, log files, and similar tools (“data collection tools”) to:

Measure performance
Understand feature usage
Fight fraud / abuse
Deliver or measure marketing and interest-based messaging
Improve user experience and product quality over time
Most browsers and mobile devices let you block or delete cookies/IDs.
Blocking certain cookies or IDs may limit parts of the Services. We currently do not respond to browser “Do Not Track” signals. If that changes, we’ll update this Privacy Policy.
6. AI Features
Some parts of the Services may use AI systems (for example: automated Q&A, summarizing your data, surfacing non-clinical recommendations). These features are evaluated for quality and fairness, and we may review interactions to improve safety and performance. We do not allow AI alone to make legally significant decisions about you without human review.
7. Text Messaging
By using the Services, you consent to receive SMS/text messages from Planck and certain partners, including service updates, logistics, reminders, and limited promotions. Standard carrier rates apply. Message frequency may vary. 8. Marketing / Analytics / Opt-Out
We may use analytics and advertising tools to understand how users interact with Planck, improve the product, and present relevant content. You can often opt out or limit tracking via those platforms’ own privacy/opt-out settings, industry tools, and/or device settings.You can also tell us directly that you don’t want marketing emails or promotional texts. We’ll still send transactional messages that are required to deliver Services you’re actively using (for example, “your lab kit shipped”).
9. When We Share Personal Information
We do not sell your Personal Information. We also don’t “share” it for cross-context behavioral advertising except as described in this Policy.We may disclose Personal Information to:Affiliated Providers you choose to work with (clinicians, labs, pharmacies, imaging centers)

Some regions, including certain U.S. states, give residents specific rights to know, delete, opt out of targeted ads / sale / profiling, limit sensitive data use, or avoid discrimination for exercising those rights. We honor those rights as required by law.Users in the UK and EU-style jurisdictions generally have rights to access, correct, delete, restrict processing, object to processing, and request portability of Personal Information, and also have the right to lodge a complaint with a data protection authority.Users in India have rights under India’s data protection framework, including access, correction, and grievance redress. 11. Children / Minimum Age
The Services are designed for adults. Individuals under 18 (“Minors”) are not allowed to create accounts or send us Personal Information. We do not knowingly collect data from Minors. If you believe a Minor has provided data, contact support@planck.health and we will remove it.
12. How We Protect Personal Information
We use technical, administrative, and physical safeguards aligned with industry standards to protect against unauthorized access, accidental loss, alteration, or disclosure of Personal Information. These protections scale with the sensitivity of the data (for example, Healthcare Information is treated with stricter controls).You’re responsible for keeping your login credentials secure. If you believe your account security is compromised, tell us immediately at support@planck.health.If there’s a breach of security, we will investigate, take steps to remediate, comply with applicable breach-notification laws, and follow any required reporting or cooperation obligations.
13. Data Retention
We keep Personal Information as long as needed for business operations, to deliver the Services, to comply with legal obligations, to resolve disputes, to prevent fraud, and to enforce agreements. After that, we dispose of it consistent with our retention and deletion policies and applicable law. Affiliated Providers may have their own retention rules.
14. Links and Third Parties
The Services may link out to websites, apps, labs, pharmacies, wearable/device companies, or other services we don’t control (“Third-Party Services”). Their privacy practices are their own. Planck is not responsible for their data handling, security, retention, or compliance. Personal Information collected directly by those independent providers (for example, a clinician or lab you choose to work with) is governed by that provider’s own notice.
15. International Data Transfer
Planck is based in the United States, and we may store and process data in the U.S. and in other countries where we or our vendors operate (including the U.K., EU, or India). By using the Services, you understand your data may move across borders to jurisdictions whose data protection laws may differ from the laws where you live. We apply safeguards required by applicable law when we transfer data internationally.

You can opt out of marketing emails (email support@planck.health). We may still send you non-marketing messages needed to run your account or deliver services you requested (for example, “your results are ready”)

1. What “Services” Means
Planck owns and operates the Planck website, app, dashboards, membership features, analytics, and any other related properties we control (the “Platform”). “Services” means the Platform plus the content, features, tests, marketplace, programs, messaging, and other offerings we make available, including any affiliated site, software, or application we operate.
2. Planck Is a Technology Company
Planck is not a medical group, clinic, pharmacy, lab, imaging center, or hospital. We do not diagnose, prescribe, or treat. We do not provide primary care.Instead, Planck helps you access services from independent third parties such as clinicians, mobile phlebotomists, labs, imaging centers, pharmacies, and other wellness or performance providers (“Providers” or “Affiliated Providers”). Those Providers make their own clinical decisions. They are responsible for their own quality of care. Planck does not control that clinical judgment.You should get advice from a qualified healthcare professional before relying on any insights in the app. Never delay seeking in-person medical attention because of something you saw in Planck. If you are experiencing an emergency or believe you might be experiencing a serious or life-threatening condition, call your local emergency number immediately (for example 911 in the U.S. / 999 in the U.K. / 112 in India) or go to the nearest emergency department.Any guidance you get from a Provider via the Services depends on the information you supply (your “Healthcare Information,” as defined in the Privacy Policy). If you give incomplete or inaccurate info, the guidance may be incomplete or inappropriate.The Services and data surfaced by the Services are not a medical device and are not a substitute for the independent judgment of a licensed clinician.
3. Ownership
You must create an account (“User Account”) to access most Services. Planck and its licensors own all rights in and to the Services, including text, visuals, code, analytics, educational content, designs, UI, and any other material (“Content”). That Content is protected by copyright and other IP laws worldwide.We grant you a limited, personal, revocable, non-transferable, non-sublicensable license to access and use the Services, strictly for your own individual, non-commercial use, subject to these Terms. We reserve all other rights. You may not resell, sublicense, or exploit the Services without our written permission.You agree not to remove or alter any Planck or third-party branding, marks, or proprietary notices.If your jurisdiction prohibits use of the Services (for example, local regulations around at-home testing, telehealth, data access, or biomarker review), do not use the Services in that jurisdiction. You are responsible for any carrier, data, or connectivity charges related to your use.
4. Your Promises to Us
By using the Services, you represent and warrant that:
You are at least 18 and legally able to agree to these Terms;
All information you provide (profile data, health info, location, etc.) is accurate, current, and complete — and you’ll keep it updated;
You are allowed to create this account (for yourself or, if applicable, for another person with proper authority);
You consent to our Privacy Policy;
You are legally allowed to share with us the Personal Information you submit;
You are not barred from using the Services under applicable law (for example, sanctions lists)
5. Geographic / Age Limitations
Some Services (for example lab draws, prescription review, or certain concierge experiences) are only offered where we have licensed Provider coverage or where law allows them. Some offerings have age limits. We may change availability at any time.
6. Your Personal Information
You own your Personal Information. When you use the Services, you are granting Planck the rights we reasonably need to operate, deliver, and improve the Services — for example, to receive, store, process, analyze, transmit, and (where legally allowed) de-identify your data to support product development and quality improvement. This includes a worldwide, transferable, sublicensable license that lets us use your Personal Information as needed to run the Services and meet legal requirements, subject to applicable law and our Privacy Policy. You also agree we may create and use de-identified and/or anonymized data derived from your Personal Information (including Healthcare Information) for any lawful purpose.
7. User Submissions
Anything you send through the Services — questions, forms, chat messages, uploaded documents, comments, suggestions, etc. — is a “Submission.” Subject to any account-level settings and applicable law, you grant Planck a broad, worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, display, perform, and distribute those Submissions so we can operate and improve the Services.You confirm you have the right to share that material and that it doesn’t violate anyone else’s IP or privacy rights.
8. AI Chat / AI Features
We may offer automated assistants or AI-driven chat (“AI Chat”).AI Chat can use machine learning models and third-party AI infrastructure to generate responses.Your messages to AI Chat (including Personal Information) may be processed to generate answers, improve safety, improve model quality, and enhance the Services.You can contact us at support@planck.health if you want to limit use of your personal data for AI training.AI Chat is educational and informational. It is not medical advice and may be incomplete, outdated, inaccurate, or unsafe.Do not use AI Chat for emergencies, urgent conditions, crisis situations, or medical decision-making. Always talk to a qualified clinician for diagnosis or treatment.
9. App Store / Mobile App Terms
If you access Planck via an iOS App Store or Google Play download, you acknowledge that:These Terms are between you and Planck, not Apple or Google.Apple/Google are not responsible for support of the app.Apple/Google are third-party beneficiaries who can enforce applicable parts of these Terms as they relate to their stores.You must follow the relevant app store rules.10. Payment, Billing, and Terms of SaleWhen you provide a payment method, you confirm you’re authorized to use it and you authorize us (or our payment processor) to charge it for the amounts shown (including taxes, shipping, or other fees). If your payment fails, we may suspend or cancel your order or membership until the issue is fixed.Prices, taxes, shipping, and availability can change. We may correct obvious pricing/checkout errors. Some items or services may be limited in quantity or geography. Risk of loss for physical items typically transfers when we hand the shipment to our carrier, unless we say otherwise in writing.
11. Privacy
See the Privacy Policy for exactly how we collect, use, share, and protect Personal Information, including Healthcare Information. By using the Services you consent to the Privacy Policy and acknowledge we may share Personal Information with Providers and certain partners when necessary to deliver Services, consistent with law and the Privacy Policy.
12. Accounts, Passwords, and Security
You are responsible for safeguarding your login credentials. If someone else uses your credentials to access the Services, you are responsible for that activity. You agree to notify us immediately if you believe your account has been accessed without authorization. We reserve the right to suspend or terminate access if we believe your account is compromised or you are misusing the Services.

Use the Services for any unlawful purpose
Misrepresent your identity or your eligibility to use specific Services
Attempt to obtain prescriptions, diagnostic services, or clinical opinions for someone other than yourself without proper authority
Scrape, copy, reproduce, resell, exploit, or reverse engineer any part of the Services
Interfere with, disrupt, or degrade the operation or security of the Services
Upload viruses, malware, or other harmful code
Use the Services to send spam, chain letters, or unsolicited marketing
Use the Services in a way that infringes, misappropriates, or violates any third party’s intellectual property, privacy, publicity, or other rights
We may investigate suspected violations and may block, suspend, or terminate any User Account at our sole discretion.
14. Service Changes, Availability, and Beta Features
We may change, suspend, or discontinue any part of the Services at any time. We may launch new or experimental features (including beta features) that may change or break without notice. We’re not liable to you for those changes.We do not guarantee that any particular test, feature, Provider, shipping method, or geographic coverage will continue to be offered.

To the maximum extent allowed by law:
The Services, Content, AI Chat, recommendations, educational material, analytics, dashboards, and any other output are provided “as is” and “as available,” without warranties of any kind, either express or implied.We disclaim all warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and all warranties arising from course of dealing or usage of trade.We do not promise the Services will be uninterrupted, secure, or error-free, or that any information is complete, accurate, or up to date.We do not practice medicine. Independent Providers are responsible for the medical care they provide. We are not responsible for the acts or omissions of Providers, labs, pharmacies, imaging centers, shippers, or other third parties.Some jurisdictions do not allow certain disclaimers. In those jurisdictions, these disclaimers apply only to the extent permitted by law.
16. Limitation of Liability
To the maximum extent allowed by law:
Planck (including our affiliates, officers, directors, employees, contractors, agents, successors, and assigns) will not be liable for any indirect, incidental, special, consequential, statutory, exemplary, or punitive damages, or for any loss of profits, loss of data, loss of goodwill, service interruption, computer damage, system failure, or cost of substitute services, arising out of or in connection with these Terms or your use of (or inability to use) the Services.
Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow limitations of liability for personal injury or for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
17. Indemnification
You agree to defend, indemnify, and hold harmless Planck and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with:
Your access to or use of the Services
Your breach of these Terms
Your violation of any law or the rights of any third party
Any claim that your Submissions or Personal Information infringes, misappropriates, or violates any third party’s rightsAny dispute between you and a Provider or other third party
18. Governing Law
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-law rules that would result in applying the law of any other jurisdiction. Some Services may separately require compliance with local laws in the U.K., EU, or India; using those Services means you agree to follow the local rules that apply to you.
20. Termination
We may, at any time and without notice, suspend, disable, or terminate your access to some or all of the Services, including if we believe you violated these Terms or are using the Services in a way that creates risk for us or for others.You may stop using the Services at any time. You may also request account closure by emailing support@planck.health. Certain obligations (payment owed, confidentiality, IP ownership, indemnification, limitation of liability, dispute resolution) will continue to apply even after termination.
21. Assignment
You may not assign, transfer, or delegate these Terms, your rights, or your obligations without our prior written consent. We may assign these Terms, in whole or in part, without notice, including to an affiliate or in connection with a merger, acquisition, restructuring, financing, or asset sale.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
23. Entire Agreement
These Terms, together with the Privacy Policy and any other terms linked or referenced in the Services, are the entire and exclusive understanding and agreement between you and Planck regarding the Services, and they supersede any prior oral or written understandings or agreements.
